The family of a girl who was killed by a train in California last September has filed a wrongful death lawsuit against the city of Mission Viejo.
According to court documents, the family of 17 year-old Anastasia Bolton has filed a $5 million wrongful death claim against Mission Viejo. Bolton was struck and killed by a Metrolink train in September after apparently falling asleep on the train tracks. The accident, which occurred on the tracks underneath the Alicia Parkway overcrossing in Mission Viejo, claimed the lives of Bolton, and 22 year-old Daniel Akins.
Bolton’s mother, Stephanie, filed the wrongful death lawsuit against the city, claiming her daughter’s death was preventable. The lawsuit cites premises liability and sates “no fencing or other warning existed in the area where Anastasia accessed the tracks.” The lawsuit claims the city failed “to maintain proper restriction and/or warning to area of high traffic and inherent danger.”
The claim requests $5 million in damages and an unknown amount of future costs, calculated based on “wrongful death, costs, and life expectancy.”
